Regarding how to properly handle fund arrears, lawyer Lin Jing stated that fund arrears may stem from various legal relationships, such as sales, leasing, torts, labor relations, and compensation, which are debts incurred by the debtor due to failure to fulfill contractual obligations. After falling into arrears, the debtor may issue an IOU or may confirm the labor relationship through arbitration to claim the owed amount. The legal relationship reflected in the IOU is quite complex and may involve multiple contractual relationships. If the reason for the debt is a loan, it is recommended to issue a loan note, as the legal relationship reflected in a loan note is straightforward, clearly indicating that the debt is a loan dispute. As long as there is a loan note and the loan has been actually delivered, rights can be claimed based on the loan note and transfer proof, and the court will support this.
